Decide on Wadia trust issue in two weeks: Bombay High Court

The Bombay high court on Tuesday directed the Wadia Trust to file an application seeking permission to start a paediatric organ transplant centre at the Nawroji Wadia Maternity Hospital instead of Bai Jerbai Wadia Children's Hospital, which is under repairs. The application should be addressed to Brihanmumbai Municipal Corporation and the Maharashtra Pollution Control Board (MPCB).

The Bombay high court on Tuesday directed the Wadia Trust to file an application seeking permission to start a paediatric organ transplant centre at the Nawroji Wadia Maternity Hospital instead of Bai Jerbai Wadia Children's Hospital, which is under repairs. The application should be addressed to Brihanmumbai Municipal Corporation and the Maharashtra Pollution Control Board (MPCB).

A division bench of chief justice Mohit Shah and justice GS Kulkarni directed the BMC and MPCB to decide on the trust's application within two weeks by carrying out a survey and after clearing the deficiencies, if any, of the trust.

The trust had initially submitted a proposal to the state government for starting of the centre at Bai Jerbai Children's Hospital. However, since the hospital is under renovation, the trust sought to start the organ transplant centre at the maternity hospital from where the children's hospital is also functioning.

According to the proposal sent in July last year, if the centre is approved then it will be one of its kind in the world. After the repairs are completed, the hospital will be able to house 150 beds in the Neonatal Intensive Care Unit, 24 beds in the paediatric Intensive Care Unit. Located in Parel, The hospital is operating from its neighbouring premises since 2009.

Activisit Kamayani Mahabal had moved the high court alleging that no steps have been taken by the authorities to take up the renovation work and compete at the earliest. As per the petition on May 15, 2009, the acting dean issued a circular stating that due to renovation services were being shifted to the maternity hospital in the next compound with immediate effect. The hospital has 34 paramedical, 123 medical and around 120 menial staff.

The court has now adjourned the hearing by six weeks.
