Mother of rape victim shields her from grilling by lawyers on the stand

The mother of a 10-year-old rape victim took a strong stand on Tuesday and requested the POCSOA court to keep her child from testifying at the witness box, after she was subjected to a harrowing session on Tuesday. The wailing mother justified her ask stating that she doesn't want her daughter to recollect the traumatic incident.

Moved by her plea, the court agreed to run the trial in accordance with her request. Jyoti Sawant, Special Public Prosecutor said, "The mother was testifying to the prosecution and the defense advocates grilled her to describe the incident down to the minutest details. This disturbed the mother to such an extent that she started crying bitterly. Finally, towards the end of the session, she informed the court that a similar testimonial would leave her child harrowed, and she couldn't let that happen."

The incident took place in the year 2014, when the accused Hussain Sheikh (30), a resident of Mahim slums, had raped the minor, who was staying next door. The child was so disturbed by the incident that the mother had to take her to the village, so that it doesn't haunt the child.

"The mother informed the court that the incident wasted two years of the child's schooling, and it is only now that she has regained normalcy. It would thus be unfair to put the child through the ordeal again, making her recall the incident, down to the smallest detail. This is why she decided against allowing her daughter from testifying at the witness box," said Sawant.

After the incident, the prosecution put an option before the court to appoint a committee, who would visit the victim's house and record her statement. The court has kept the options open to the mother's approval. Based on her decision, the committee shall work on the matter.
