The Bombay High Court recently allowed an Inter-country adoption of two minors, who were abandoned by their biological parents behind a post office in Navi Mumbai, when they were four and three years old, in 2016.

Justice RG Ketkar allowed the petition filed by a couple of Indian origin, now citizens of New Zealand, to adopt the two minor children.

The children were found in 2016, and were sent to a children home in Nerul. After due formalities were completed, the children were declared to be legally free for adoption. Even Central Adoption Resource Authority (CARA) granted a no objection certificate for allowing an inter-country adoption of the children.

The couple, both employed in their country had sought the adoption, because they could not have their own children, due to infertility issues and numerous unsuccessful treatment attempts. The scrutiny report given by the authorised agencies gave a go-ahead after due verification of their records. The couple also gave an undertaking to the court setting out details about another couple in New Zealand, who would take responsibility of the minor children in the event of their sudden death.

The court, after going through the record and the necessary approvals, said: “I think it will be in the interest of the children, if they are adopted by the proposed adopters.”

The court thus allowed the petition filed by the children home, seeking permission for inter-country adoption.
