Confirm shikshan sevaks after three years of working: State

The state government on Friday informed the Bombay High Court that it has brought in an amendment to the Maharashtra Employees of Private Schools Act, which will benefit thousands of shikshan sevaks in the state.

The state government on Friday informed the Bombay High Court that it has brought in an amendment to the Maharashtra Employees of Private Schools (Regulation of Conditions) Act (MEPS), which will benefit thousands of shikshan sevaks in the state.

A few years ago, the government issued a resolution, which introduced the concept of shikshan sevaks. Schools run and aided by the state government were allowed to employ shikshan sevaks, at modest salaries, to overcome shortage of funds that prevented them from employing regular teachers.

The resolution also said that after serving as shikshan sevak for three years, the person shall be confirmed as a regular teacher. But the resolution came into conflict with MEPS Act, which demanded that a person must serve as a probationary teacher for two years before being confirmed as a regular teacher in schools.

The school authorities were of the view that that shikshan sevaks were not probationary as per definition so they cannot be confirmed directly even after three years of service.

Shikshan sevaks, Ram Awadh Pal and Ram Lochan Pal, moved the Bombay High Court over the issue. On Friday, arguing before a full bench of Justice JN Patel, Justice DY Chandrachud and Justice Roshan Dalvi, associate advocate general Ashutosh Kumbhkoni said that the government has amended the MEPS Act, those who have served as shikshan sevaks for three years shall now be confirmed as permanent teachers, without probation.

The court is yet to pass a formal order, but the amendment is likely to bring cheer to shikshan sevak's across the state.
