Civic body’s eviction notice to Paraplegic Foundation stayed

The Bombay high court on Wednesday stayed the eviction notice issued to Paraplegic Foundation by the Brihanmumbai Municipal Corporation (BMC) till February 28. The foundation functions from a barrack at the LTMG Hospital in Sion. The court, however, asked the foundation to work out a via-media solution with the civic body as the latter plans to start a blood bank from the premises, which is in the larger interest of public.    

A division bench of Chief Justice Mohit Shah and Justice MS Sanklecha stayed the notice issued on January 6 and asked the foundation to move to another barrack. The court also directed the corporation to file their reply to the petition by February 17.        

The petition’s main grievance is that the alternative accommodation provided to them is around 4,000 square feet which is less than the present space (14,000 sq. ft.) occupied by them. It also states that the toilets in that place have steps which the paraplegics will not be able to climb.      

The court suggested to the civic body and the foundation to work out a solution. It said space in two different barracks could be provided as many barracks inside the hospital premises were vacant. As per the petition, the foundation was formed in 1968 and it runs on ‘donor funds’. It’s work is completely philanthropic in nature.
