Cidco starts deemed conveyance process in Navi Mumbai

Even as Mumbaikars are getting deemed conveyance done for their housing societies after battling non-cooperative developers and landowners, the case in Navi Mumbai has been different, with state government-controlled Cidco being the landowner. But now, finally, Cidco has started the process for deemed conveyance in the satellite city after the state government issued a GR 15 days back regarding this.
The government has implemented deemed conveyance system in other parts of the state, only Navi Mumbai had been out of the purview, until now.

What is deemed conveyance?
Simply put, it is giving legal rights to a housing society over the land it is standing on, making it the owner of that plot. It also enables the society to avail benefits, such as opting for extra floor space index (FSI) or going in for redevelopment, without having to wait for a no-objection certificate (NOC) from the development authority.

Who will benefit from this move and how?
The decision will benefit over 6,000 housing societies and lives of lakhs of Navi Mumbaikars, particularly those living in dilapidated buildings, by giving them the right to carry out redevelopment without any legal hindrance. Residents will also be in a position to directly secure extra FSI.
The immediate benefit of deemed conveyance for housing societies is that residents won't have to pay property transfer fee, which runs into lakhs, anymore, neither to Cidco nor to NMMC for every sale or change of member in the housing societies.

What's the minor catch?
Cidco has made it clear that executing deemed conveyance in favour of housing societies does not mean the plots of land are being converted from leasehold to freehold.

How does the decision benefit Cidco?
The development authority stands to benefit if it hands over the ownership of the land to the society members as employees dedicated to administering these long-developed areas will be free to take up development in new areas, which is Cidco's core responsibility.

How can a housing society get deemed conveyance?
An official from joint registrar (Cidco) said housing societies can get deemed conveyance executed on payment of a court fee stamp of Rs2,000. "Residents do not have to pay anything more than this," added the official, PB Korde. He, however, advised housing societies to get the paperwork done in a proper manner before going in for this.

What are the documents required?
The society has to make representation on Form No 7, which is a common form, for deemed conveyance. The other documents needed are society registration copy, registered copy of chairman, secretary, sale agreement of all the flat owners, agreement to lease (as applicable), development agreement, commencement certificate, completion certificate and occupancy certificate, draft of deemed conveyance, architect certificate, title certificate and title clearance certificate, plan with NMMC or Cidco, and letter which was given to developer to get the deemed conveyance done to which he has not responded.

What are Navi Mumbaikars saying?
Nationalist Congress Party corporator and secretary of the apartment association in Vashi Kishore Patkar said, "This is the first step towards converting land in Navi Mumbai from leasehold to freehold. The decision is not only an attempt to rein in Cidco's authority but also an attempt to control all those unscrupulous developers who were taking lakhs to issue NOCs to buyers in case of transfers."

"Nowhere in Maharashtra are residents charged double for the same transaction. It is only in Navi Mumbai that we have to pay both Cidco and civic body. With this move, people will be able to save lakhs they were paying towards transfer charges to the planning agency," he added.

Meanwhile, residents have pointed out how corruption has derailed the deemed conveyance scheme in Mumbai. "If you want the scheme to be a success, corruption will have to be stamped out. In Navi Mumbai too, if corruption within Cidco is removed, the scheme can be a success," said a resident.
