Chembur builder booked for failing to give possession of flat

Chembur police has registered a case against construction company Joynest Premises Private Limited and its five directors for allegedly violating the norms of Maharashtra Ownership of Flats Act (MOFA) and for allegedly cheating a flat buyer of Rs 55 lakh.

According to the one of the victims and complainant Pravin Desai, he had booked a flat at Hubtown Season in Chembur in 2014 when the builder had promised him possession of flat by June 2017. However, work on the project has not started yet even after crossing the promised date of possession. The complainant has also claimed in his statement that after paying 25 per cent of the decided amount, Rs 55 lakh, the builder has not given an agreement yet and on being asked for the money back, has not returned it, violating the MOFA. "Te builder kept delaying the project on several pretexts. When we asked why they are not providing an agreement, they said they have not received approval of the plan yet and hence couldn't do it. I waited two years, but now the possession date has also passed," Desai told DNA.

"We have registered a case against the company and its directors after verifying the claims of the complainant. Our probe is on and we will take appropriate action soon," said a police officer from Chembur Police Station.

A case has been registered under sections of MOFA and Indian Penal Code for cheating.
