Cheating woman's husband gets divorce on ground of cruelty

The family court has ruled that a man is entitled to divorce on grounds of adultery and cruelty if the wife continues an affair with another man even after marriage.

Principal judge Laxmi Rao granted divorce to a 30-year-old man on the grounds of adultery and cruelty whose wife left his home within two months of marriage, after confessing that she had married under pressure from her parents, and later started living with her former lover.

The marriage took place on June 24, 2012, at Nerul, Navi Mumbai. According to the husband's petition, within a week after marriage, the wife went to her parents' house and returned after the husband went to pick her up after 10 days.

On July, 22, 2012, the wife's father visited them and she again left with all her sarees including wedding saree. For the next two weeks, she did not answer his phone calls and refused to return. She returned only after the husband and his friend went to pick her up. The petition also alleges that she refused any physical relations with her husband, and hence the marriage was not consummated.

From August 12, 2012, the wife started behaving erratically and would quarrel with her mother-in-law without any reason. She even confessed to her mother-in-law that she had married due to pressure from her father and brother and said she was in love with another man.

On August 24, 2014, the wife left for the final time for her parents' house. The husband later received a draft for divorce by mutual consent from her.

In March 2013, when the husband and his mother visited the wife's place, they learnt that she was missing for the past 10 days and a complaint was filed with the Neral police station. On April 3, 2013, the wife's brother found her living with her former lover. The police was accordingly informed and the missing complaint withdrawn.

The husband then filed petition a claiming that the wife cheated him by suppressing the truth. "She has treated him with utmost cruelty without any reason or sufficient cause," it alleged. Despite the court's notice, the wife and her lover failed to appear before the court.
