Cheating case filed against builder on court order

The Malabar Hill police on Tuesday registered a case of cheating against Mantri Realty acting on the instructions of the sessions court.

The complainant, Ashok Commercial, had approached the Girgaum court recently following which the court ordered the Malabar Hill police to register a case under Section 420 (cheating) and 34 (common intention) against Mantri Realty.

According to the police, the complainant had given Rs71 crore in 2008 allegedly for business purpose. However, the money was not returned in the stipulated time following which the complainant decided to approach the court.  An officer said they received the court orders late on Tuesday evening following which a case was registered later in the night.

“We have been instructed to investigate the case. We will now call the persons involved for questioning and record their statement. Following which we will submit the report to the court. No arrests have been made in the case so far,” the officer added.

When contacted Sunil Mantri, chairman and managing director of Mantri Realty, said, “The money was taken for development of a property in South Mumbai. This amount was later adjusted as a booking amount or advance for an entire floor in the property to be developed in South Mumbai by my company. If I am not wrong some of the amount is still to be paid by them (the complainant).
The development of the property is yet to start. However, since I have not been informed or alerted by the cops about the nature of the complaint and the charges against my company, I would prefer to read the complain papers before commenting any further.”

Mantri said due to some problem the project could not be started and that they will follow the basic norms of returning the money given to them for booking of the property in case any person wants it back. “We will approach the high court for quashing of the order,” Mantri said.

Nisar Tamboli, DCP (zone-2), confirmed that a cheating case had been registered against Mantri Realty. He said the case might be transferred to the Economic Offences Wing (EOW).
