Campa Cola residents don't have money to fight case

Even as the Brihanmumbai Municipal Corporation (BMC) has issued tenders to demolish illegal portions of seven buildings in Worli’s Campa Cola Compound, there is no end to the woes of occupants of unauthorised floors. The civic body is set to demolish the illegal floors within three months.

The BMC had planned the demolition of illegal portions in May after issuing a 48-hour eviction notice. But the residents had approached the SC, seeking more time. The SC had granted them five months’ time, which ends in October.

However, lack of funds to fight the case and dispute among residents about the fate of the review petition have come as a roadblock in their fight in retaining their houses.

“A section of residents who are going to lose their residences are finding the legal battle financially unaffordable due to apprehensions about whether the last effort succeeds or not. Thus, their struggle to see the review petition is heard stand affected,” a resident said, requesting anonymity.

He added that such difference of opinions has led to disputes among residents. “The review petition is yet to be heard. Whether the SC considers it or not is also an issue,” he said.

Nandini Mehta, one of the residents of  the compound’s Orchid Tower who are facing eviction, refuted the claims saying it is untrue. She said all the residents of the seven buildings have been united and will remain so.

“We are positive about hearing of the review petition. We are prepared to pay for regularising if the SC asks so or ready to follow any other measure it wants us to follow. So, there has been no fund related concerns in the first place,” Mehta said, adding that residents have also pinned their hopes on a curative petition pending before the Bombay High Court.
