Builder won't sell flats to convicts in Goregaon project

A builder in the city intends to not sell flats to individuals convicted for an offence relating to moral turpitude, or any other offence that attracts a sentence of more than six months. A person issued a warrant by the central or the state government for money laundering won't be eligible either. The builder is Ekta World and the project is Ekta Tripolis, located in Goregaon.

These terms have been mentioned in the agreement copy of the project.

The clause is mentioned under the sub head: Event of default and consequences.

It reads, "The promoter shall be entitled (but not obliged) to terminate the agreements of any of the following events (event of default)."

Among the sub clauses listing the conditions is one that reads, "If the allottee is/are convicted of any offence involving moral turpitude and/or is sentenced to imprisonment for any offence for not less than six months."

The clauses are very specific, and the builder confirmed their presence in the agreement. "I am creating a community, and hence we don't want convicted people to stay here. Also the agreement mentions shall be entitled but not obliged so this has to be considered too," said Ashok Mohnani, Chairman of Ekta World.

  • Advocate Vinod Sampat claims that a builder cannot discriminate prospective buyers on such grounds . "There is no law that prohibits anyone, including an individual convicted for an offence to buy a house. The job of a builder is to sell via agreement and make a contract, not do all this," he said.
