Borivali residents file FIR against teacher who injured dog with speeding car

A dog was injured by a speeding car in Borivali

Animal lovers on Wednesday filed an FIR against the driver of a teacher who allegedly ran over an old dog in Borivli's Madonna Colony. While an onlooker watched in shock as the car hit the dog which was standing near the pavement, what the complainants found most cruel was that the teacher, who a witness claimed was seated in the vehicle, did not even stop to help the animal.

The incident was captured by a CCTV camera installed in the adjacent building, which clearly shows the maroon car running over the dog, which is then seen writhing in pain. The dog is alive, but unable to move.

Edwin Sequeira, the colony's chairman, along with another resident Louella Rebello, rushed the canine to a clinic, said, "A lady who witnessed the incident broke down when she was giving a statement to the police. I was at home when I got a call that the dog had been hit. When I went down, I saw it whining in pain. The scene was heart-wrenching. The dog is just lying there, unable to move."

Sequeira then called Harsh Shah of NGO Bird Helpline and Salim Charania of Peace for Animals Welfare (PAWA). While examining the CCTV footage, they realised that the car belonged to Marina Agera, a resident of the same colony. "Once we had taken the dog to the clinic, we went to Marina's house to speak to her about what happened. 

The moment she saw us, she asked, "Is the dog dead?". This indicated that knew what had happened. She offered to pay for the treatment, but later called us and said that her husband, Dr Valerian Agera, had told her not pay, and that he would 'handle us'," said Sequeira.

"We then approached Dr Agera. He said it was the dog's fault. He told us that he was a doctor for humans not animals. He even said that if a dog comes in the way and he was in a hurry, he would not stop his car," said Rebello.

When dna contacted Marina Agera, she said, "We did not see the dog. Later, the driver told me a dog had come under the car. My husband is innocent. He was just protecting me."

Charania and Shah accompanied the two to MHB police station, where an FIR was registered under under sections 279 (rash driving) and 428 (mischief by killing or maiming an animal) of the Indian Penal Code, and 11a (beats, kicks, over-rides, over-drives, over-loads, tortures or otherwise treats any animal so as to subject it to unnecessary pain or suffering) of the Prevention of Cruelty to Animals Act.

"The police were extremely cooperative and took action immediately," said Rebello. "Yes, the FIR has been registered. We will arrest the driver soon," confirmed sub-inspector Maladkar of MHB police station.
