Bombay high court upholds life term of man who killed wife for 'not cooking good food'

The Bombay high court has upheld the conviction of a man who killed his wife after quarreling with her alleging that she did not cook good food.

A division bench of justices VK Tahilramani and Ajey Gadkari upheld the life sentence awarded to Shivaji Gatade, resident of Kolhapur, who killed his wife, Surekha, with a stick in 2009.

"After taking into consideration the entire evidence on record, we are of the firm opinion that the appellant (Gatade) alone is the perpetrator of the present crime," observed the judges.

According to additional public prosecutor VR Bhosale, on November 12, 2009, Gatade had an argument with his wife over the preparation of food. He then hit her head with a stick and ran away.

At the time, Gatade's parents and his two children were sleeping in an adjoining room. Before killing his wife, Gatade locked the door connecting the rooms.

His parents woke up after hearing Surekha's cries but could not reach her as the door was locked. Gatade's father then managed to open the door. They saw Gatade running away with a stick in his hand and noticed Surekha lying in a pool of blood.

Neighbours too gathered at the door, after hearing Surekha's cries. Though one of them tried stopping Gatade, he managed to escape. The police nabbed him the next day.

Gatade's parents testified that he used to often consume liquor and beat Surekha on the ground that she didn't cook well. Even on the fateful night, Gatade had come home drunk and fought with Surekha. His mother, Malutai, tried to pacify him and asked him to go to bed.

However, defence advocate Sarojini Upadhyay argued that the prosecution had failed to prove motive.

The judges, however, upheld his conviction observing: "The mother and father of the appellant (Gatade) have, in unequivocal terms, stated the commotion which took place in the adjoining room in the house between the appellant (Gatade) and Surekha on the day of the incident."
