Bombay high court temporarily stays deportation of Pakistani man

The Bombay high court on Monday stayed the deportation of Siraj Khan, who claims to be from Pakistan Occupied Kashmir, and has been living in India with his family.

The HC was hearing a petition filed by his wife Sajida, challenging the order of the sessions court refusing to grant him relief.

The HC will hear his plea against an order of his detention by the special branch. Plus, his application to the Indian government for citizenship is still pending.

Sajida claimed that Khan has been in detention for over two months without any justification.

The detention order by the police at the special branch (II) says that he is likely to indulge in anti-national activity. However, Sajida claims that there is no explanation to justify it in the order.

Siraj had come to India inadvertently as a little boy of 10 on a train and has been earning a modest income while trying to raise a family.

He was detained at the Children's Home in Ahmedabad and has undergone his six-month sentence too, after being convicted by a magistrate in January for residing in India as a Pakistani national without documents.
