Bombay High Court stays Rs 10 lakh compensation to injured Worli local

The Bombay High Court on Monday stayed the execution of the compensation of Rs 10 lakh by the Brihanmumbai Municipal Corporation to a 77-year-old Worli-based Pimmi Seth, who had suffered severe injuries allegedly due to an uneven paver block on the sea-face promenade.

The state Human Rights Commission (SHRC) had directed the BMC to pay the compensation in May for the injuries Seth had sustained after falling on October 9, 2017, due to an uneven pavement block during her morning walk.
The commission had, in its order, stated that it is the civic body's responsibility to maintain roads and promenades. It had taken suo motu action against the corporation and directed the civic commissioner to pay a compensation of Rs 10 lakh to Seth for "violation of her human rights". The amount was to be paid within six weeks, failing which an interest of 12.50 per cent per annum will have to be paid on the awarded amount until its actual realisation.

However, challenging the order, the corporation stated that the commission had wrongly awarded the compensation. It said was no evidence recorded by the commission to indicate that the woman had fallen due to an uneven paver block. Following this, the court stayed the order of the commission and issued notice to Seth to reply to the petition filed by the corporation.
