Bombay high court stays order handing Rajesh Khanna's will to Anita Advani

Admitting the appeal filed by Twinkle Khanna, daughter of deceased actor Rajesh Khanna, the Bombay high court on Monday, stayed an order of the single judge, allowing Anita Advani, the live-in partner of Khanna, to be given a copy of his will.

A division bench of chief justice Mohit Shah and Justice MS Sonak, stayed the order of the single judge, which had noted that it was not necessary to issue a notice to the parties concerned when a third party seeks documents in a private matter.

Twinkle who has sought to probate the will of the later actor had challenged the order of Justice RD Dhanuka, directing the registry to provide will related documents to Advani.

Twinkle's lawyer advocate Birendra Saraf argued that Advani had no right to get a copy of the will as she was not a family member, nor was she a legal heir. Her claim was based on a complaint filed under the Domestic Violence Act and that did not give her the right to secure a copy of Khanna`s will.

Justice Dhanuka while allowing the plea of Advani observed that no right was being created in favour of Advani, and only the documents were being provided at this stage. Khanna died in July 2012 after a prolonged illness.

Advani, submitted that she was a live-in partner of Khanna and that he had told her on various occasions that she would be a beneficiary in his will. He alleged that family members had indulged in fraud related to the will.
