Bombay High Court says no to Jagannath Yatra at Shivaji Park

The Bombay high court on Thursday refused to grant permission to International Society for Krishna Consciousness (Iskcon) to hold their Jagannath Rath Yatra at Shivaji Park.

While dismissing Iskon's petition, a division bench of justices Abhay Oka and Anil Menon observed that Shivaji Park was designated silence zone and a playground and hence should not be used for other purposes.

The judges stated that only in "rare and exceptional" cases, the court can allow use of Shivaji Park for purposes other than sports.

Iskon had filed a petition seeking permission to hold a rally at Shivaji Park on February 21. Their advocate argued that it was not only a religious function but was also a charitable event. Prasad (offerings) would be distributed to more than 1.5 lakh people, contended Iskon.

Iskon approached the HC after the Brihanmumbai Municipal Corporation (BMC) refused to grant permission to Iskon to hold a rally at Shivaji Park. The BMC refused permission based on May 2010 order of HC declaring Shivaji Park as a silence zone.

The civic body said that the park is being used by sportsperson and children for sports and recreation.

Even last year, the HC refused to grant permission to Iskon to hold the yatra at the venue.
