Bombay High Court relief for meat shop owners

Holding the notice of suspension issued to 20 meat shop owners in Nalasopara as illegal, the Bombay High Court on Tuesday stayed the order issued to them by the Vasai Virar Municipal Corporation.

A division bench of Justice Abhay Oka and Justice PN Deshmukh said: "How can you suspend the licences and also direct the police to initiate criminal prosecution?"

The shop keepers were issued suspension notice on December 16, 2017, after the police found around 550 kg of beef in the area. The corporation could not ascertain who was the owner of the beef but it issued notices of suspension. The shop owners submitted a representation to the corporation stating that they did not sell beef. 

Their material was sourced from Thane and all the meat sold was accounted for and it was not beef.

However, the authorities refused to accept their representation and passed the order. This came to be challenged in the high court. The court holding the notices illegal have now posted the matter for final hearing on March 14, when it will decide on the authority of the corporation on issuing the impugned notice. The court also clarified that criminal law cannot be set in motion by the police.
