Bombay High Court orders CBI to further probe Adarsh Housing society scam

The Bombay High Court on Wednesday directed the Central Bureau of Investigations (CBI) to further probe into alleged role played by high ranking beneficiaries and senior politicians in the Adarsh housing society scam.

A division bench of Justice Abhay Oka and Justice Amjad Sayed while directing the CBI to file an application before the special court seeking permission for further investigations, said that the agency had not considered the order passed by the high court earlier while directing demolition of the building and action against senior officials who allotted the land.

Amrit Prasad, Joint Director of CBI (western zone), who was summoned to the court said that CBI had completed its investigations and accordingly filed its two progress reports before the court. However, if the court feels that further probe needs to be done then it would act on it.

Wategaonkar claims that CBI during the early years of investigating the case in 2011 had arrested one of the main conspirators and developer of Adarsh, Kanhaiyalal Gidwani and \"claimed in their remand papers that the reason they needed Gidwani’s custody was because he held benami flats for a few political leaders.\"

The CBI had received Gidwani’s custody based on that remand copy. However, according to Wategaonkar, \"CBI never produced any proof or even any statement of Gidwani about that issue. It did not even mention in the charge sheet filed by the CBI.\" Thus he has prayed for CBI to be ordered to disclose this through their investigation papers. He had also prayed that CBI should undertake further investigations in the case.

Kanhaiyalal Gidwani, a Congress leader from Sangli along with his family owned 10 flats in the infamous Adarsh building. He and his sons officially owned three flats, and of the remaining four, the source of
money and real owners were never disclosed. Two flats were said to be in the names of high-profile members of the state government who helped clear the Adarsh file and two in the name of prominent politicians whose identities were never revealed. Gidwani had passed away in 2012.

The entire scam of Adarsh pertains to building of a 31 storied-building illegally by few people including Gidwani and others who passed off flats as quid pro quo to politicians for giving illegal permissions. Charge sheet has been filed in the case however trial in the case is still pending. Recently high court has asked the

government to demolish the building; the order has been challenged in the Supreme Court and stayed.
