Bombay High Court order stays Garib Nagar demolition

The Brihanmumbai Municipal Corporation (BMC) has been carrying out the demolition work of encroachments along the Tansa water pipeline in full swing. However, the demolition at Garib Nagar slums in Bandra East has left the civic body in a fix, as a recent Bombay High Court order has restrained the BMC from shifting anybody other than those affected by the BRIMSTOWAD project to its Mahul rehabilitation buildings.

This order has directly affected the slum dwellers who were living along the Tansa pipeline in Bandra East and were identified to be eligible for rehabilitation after the BMC demolished their shanties.

The local corporator Haji Halim Khan from the Shiv Sena has alleged that 163 families eligible for rehabilitation are forced to stay on the road as they have not yet received the keys of their alternate accommodation at Mahul. Taking the slum dwellers woes to the civic officials, Khan led a protest at the BMC H-East ward office on Thursday. Last month, 323 shanties at Garib Nagar were demolished by the BMC.

However, Deputy Municipal Commissioner, Nidhi Chaudhari said, "Of 323, only 36 families are eligible for rehabilitation. Of the 36, 16 families have taken the keys of the Mahul homes while the other families are not yet turning up."

"We have Supreme Court's orders which say we can rehabilitate eligible tenants to Mahul," she added.

As per a Bombay High Court order of 2009, the BMC has to demolish all encroachments within a 10-metre buffer zone along the Tansa pipeline, which passes through 10 civic wards. Around 16,000 structures were to be demolished, of which only 30 percent work was done till June 2017.
