Bombay high court judge recuses himself from hearing Syedna successor row

Justice SJ Kathawala of the Bombay high court on Monday recused himself from hearing a suit filed by Khuzaima Qutbuddin, who self-declared himself as the 53rd Dai al-Mutlaq and head of the Dawoodi Bohra community, seeking to be declared as the rightful successor after the demise of Syedna Mohammed Burhanuddin.

Qutbuddin had filed the suit last week seeking him be declared as the 53rd Dai and restraining orders to Mufaddal Saifuddin, the second son of the late Syedna, who is presently holding the Syedna post. The suit also seeks directions to Mufaddal to be restrained from holding himself or doing any acts, deeds or things as the 53rd Dai al-Mutlaq of the community.

The suit came up for hearing before justice SJ Kathawalla on Monday. However, he recused himself from hearing the case as he had appeared for the late Syedna in the past in another matter. The suit will now be placed before another judge of the high court and will come up for hearing in due course of time.

Qutbuddin claimed that the late Syedna had chosen him his Mazoon (deputy) and secretly appointed him as his successor 50 years ago.
