The Bombay High Court on Monday asked the state government to list out the steps it has taken to provide amenities to senior citizens.
A division bench of Justice Shantanu Kemkar and Justice MS Karnik said, "You (state) have not complied with any of the provisions under the Maintenance and Welfare of Parents and Senior Citizens Act; this is seen from your own affidavit." The court directed senior state officials to take cognisance of the issue and come out with proper steps.
The bench made these observations while hearing a petition filed by NGO Mission Justice. The petition has sought proper publicity for the Act and its effective implementation. The government, in an affidavit filed earlier, had said that several schemes extending assistance to senior citizens have been implemented. Thus, efforts are being taken as per the rules framed under the Act.
However, Advocate Siddharth Murarka informed the court that government-aided old age homes can accommodate only around 2,000 senior citizens. He provided details about seven districts where the capacity of old age homes to the ratio of their intake of senior citizens are not as per the rules demand.
The PIL seeks directions be given to the state and Centre on implementing different aspects of the Act, which allows aged parents to seek maintenance from their children, provisions for their medical care, setting up of old age homes, among other things. A senior citizen would be someone who has crossed 60 years of age. The court has now posted the matter for further hearing on April 24.
OLD AGE HOMES
There are 62 centrally sponsored old age homes. A total of 1,550 people are benefiting from it. The state is also running 39 old age homes and 92 are being run by NGOs.
