The Bombay High Court on Wednesday directed the chief secretary to initiate inquiry into the legality of the decision taken to release water from the Gangapur dam for the 'shahi snan' at the Kumbh Mela recently.

A division bench of justices Abhay Oka and VL Achaliya said the decision taken by authorities to release one TMC (thousand million cubic) water from the dam for shahi snan went against a policy of the government, which categorises its priority list with respect to supply of water. The government has to submit a report on December 22.

According to the policy, priority has to be given to release water for drinking over other purposes, and supply of water for shahi snan comes in the last category. The direction was given during the hearing of a public interest litigation by HM Desarda, a professor from Pune, seeking quashing of the state government's decision to release one TMC water for every shahi snan, considering the state is reeling from a drought-like situation.

Earlier, it was informed that for the shahi snan on September 13 the government had released two TMC water from the Gangapur dam. By a previous order, the court had restrained the government from releasing water from the Gangapur dam for shahi snan without taking prior permission of the court.
