Bombay High Court directs BMC to take action against 250 'Shiv Vadapav' stalls

The future of Shiv Vadapav stalls that have mushroomed along the city footpaths will have to be decided by the Brihanmumbai Municipal Corporation (BMC) by the end of November, 2016. The Bombay High Court on Monday directed the civic body to pass appropriate orders against the illegally encroached road-side eateries within the next 12 weeks.

A division bench of chief justice Dr Manjula Chellur and justice M S Sonak directed the corporation to consider the writ petition filed by an association -- Janseva Mandal, as their representation and pass suitable orders on the same. Advocate Trupti Puranik appearing for the corporation, said, "Necessary orders will be passed in the time limit directed by the court."

In their petition filed through advocate Umesh Mohite, the mandal argued that around 250 stalls and carts styled as 'Shiv Vadapav' had no license from any authority. While a recent high court order had banned cooking in illegal stalls and carts in the city, as it was not permissible under the Food Safety rules. The Shiv Vadapav stalls and carts, however, operate without any authority keeping a check on them.

The petition further stated that in 1995, the government launched a scheme named 'Zunkha Bhakar Kendra', to provide wholesome food at subsidised rates to poor people. The scheme was dropped in 2000 due to blatant misuse by stall operators. Same year, a new scheme titled 'Shiv Vadapav' was floated, but was never approved. Despite that, stalls and carts under this brand mushroomed across the city.

The plea prayed for directions from the High Court to the corporation to remove all illegal Shiv Vadapav stalls, and a Special Investigation Team (SIT) to be ordered to probe the launch of the scheme and the money collected. The plea also urged for steps be taken to ensure no one was allowed to encroach upon state or municipal land under the guise of any fake public welfare scheme.
