Bombay high court asks government on steps taken to prevent drink driving cases

The Bombay high court on Monday asked the government what measures it has taken to prevent drink driving cases post the accident of actor Salman Khan in 2002.

A division bench of justices Abhay Oka and AS Chandurkar, were hearing a PIL filed by journalist Nikhil Wagle, seeking compensation for the victims and their families.

Khan had allegedly rammed his vehicle into a bakery at Bandra on September 28, 2002, killing one and injuring four others.

During the hearing on October 7, 2002, the then advocate general Goolam Vahanvati, had assured the court that he will ensure that constructive measures are taken to prevent such accidents. The HC had then asked the government to file an affidavit to the effect.

However, till date no affidavit has been filed.

Justice Oka questioned the government on its failure to file the affidavit. "More than 11 years have lapsed since the then AG made a statement. However, no affidavit has been filed as yet," said justice Oka.

In 2002, the HC had directed the actor to pay interim compensation of Rs10 lakh to the person killed. Also he was asked to pay Rs3 lakh to the seriously injured and Rs1.5 lakh to the person, who sustained simple injury in the accident.

The actor had deposited the money at the time with the court.

The court was informed that Firoz, son of the deceased Noorula, had filed an application in 2002, that the compensation money should not be given to his mother since she had remarried. The compensation amount should be given to his grandmother, said Firoz's application.

The HC has asked registrar judicial to submit a report on whether any money has been withdrawn by the victims or their families.

The HC has kept the PIL for hearing on August 1.
