Bombay High Court allows Nilesh Rane to withdraw his anticipatory bail plea

The vacation bench of the high court directed Rane to surrender before the police by May 23. Earlier, the sessions court had rejected the pre-arrest plea following which he had approached the high court.

The Bombay High Court on Tuesday allowed Nilesh Rane, son of former chief minister of Maharashtra Narayan Rane, to withdraw his anticipatory bail application that was filed last week in a case of assault and kidnapping, registered against him by his own party worker.

The vacation bench of the high court directed Rane to surrender before the police by May 23. Earlier, the sessions court had rejected the pre-arrest plea following which he had approached the high court.

The case pertains to Thane police, registering a case of kidnapping and arrest against Rane, his personal assistant Tushar Panchal and bodyguard Manish Singh. It was alleged that they had kidnapped Congress president of Chiplun Taluka Sandeep Sawant in April.

The defense advocate for Rane argued before the court that custodial interrogation was not required as investigation had been completed the statement of witnesses have already been recorded. However, public prosecutor Arfan Sait opposed the plea by saying that custodial interrogation was required, relying on medical papers of the complainant it showed that he was grievously hurt and witnesses were not coming forward because of the influence the accused and his father hold.

Justice Ajey Gadkari, thus, was inclined to refuse anticipatory bail, when the accused offered to withdraw the plea and surrender on his own before the police.

As per the FIR, Rane and his accomplices had allegedly kidnapped Sawant and assaulted him on way to Mumbai in April, for not attending a rally called by Rane at Chiplun in Ratnagiri district to demand reservation for the Maratha community. Further, Sawant was allegedly confined to a house at Andheri in Mumbai and later let off.
