Bombay High Court agrees to shift mentally challenged person from JJ Hospital to Pune home on son's request

Nikhil Jhaveri is the owner of Palm beach school, in South Mumbai, market value of which is estimated to be Rs 200 crore

The Bombay High Court, has agreed to move the owner of a Rs 200 crore property in South Mumbai, from JJ Hospital to a private mental health institute, in Pune, on his son's request.

Nikhil Jhaveri, who is suffering from Huntington's disease — a genetic disorder which affects motor functions, is the owner of the now defunct Palm Beach school located on Napean Sea road. His son Ryan, through their advocate Karl Tamboly made a statement before the Bombay High Court on Friday that on his own expenses he would move him to the Chaitanya Institute for Mental health, as better facilities are available there.

Justice SJ Kathawala, agreed to the suggestion observing that "You give the details of the institute accordingly, I will pass an order to discharge him from the hospital."

Jhaveri was shifted to the JJ Hospital on court orders, after it was found that he was not being properly taken care of by a private institute and his distant relatives/friend.

It said "Wherever, there is huge money involved, relatives surface from everywhere. They had planned a conspiracy and even the doctors were involved in it."

Tamboly said "He is my father and I will take care of him. Even if I am in USA at the moment my mother is here and she would do the needful."

He had few years back gone missing from his sister's house in Kandivali and later found loitering outside the Borivali police station and kept at an Ashram before being identified by the authorities who returned him to his family members.

Jhaveri has filed a suit in the court restraining any takeover or creating of any third party rights or any kind of dealing against his college friend Rusi Motiwalla.

The High Court has by way of an earlier order, has appointed court receiver.
