Bombay HC judge hears pleas till 3.30 am to clear backlog

Justice Shahrukh Kathawalla, a Bombay High Court Judge, ensured that every single matter listed on his board was cleared before he left for home, even if that meant working until the wee hours of Friday. Justice Kathawalla set a record in the books of High Court by hearing the pleas that sought urgent interim reliefs till 3.30 am.

Justice Shahrukh J Kathawalla presided over a packed courtroom till 3.30 am, hearing arguments and passing orders on petitions.

“The courtroom was packed with senior counsels, lawyers and litigants, whose matters were being heard. There were over 100 civil petitions that had sought urgent interim reliefs,” a senior counsel, who was present in the court till the judge rose from his seat, said.

Even at that hour (3.30 am), the judge’s energy level did not waiver and he worked till late with no fatigue on his face. It seemed like he was as fresh as one would be in the morning.

Earlier, Justice Khatawalla has been in the news for sitting in court until late hours. Two weeks ago, he had heard matters in his chamber till midnight. Reportedly, Justice Kathawalla often begins the court proceedings at 10 am, an hour earlier than the other judges, and hears matters beyond 5 pm, when the court shuts for the day.

Advocate Mayur Khandeparkar, who was present in the court till 3.30 am as his matter came up at 3.15 am said, “I remember him starting work at 11 in the morning and taking a break at 2.40 pm for lunch. However, when he started working again at 3.10 pm, he only got up by 3.30 am. I have never seen any judge work till this late in my entire career.”

Khandeparkar further said that the judge was hearing pleas that sought urgent interim reliefs and was determined in clearing the board. “He wasn’t just adjourning the matters but hearing out each case and giving the right solution,” Khandeparkar added.

“It would have been very boring if some judge was trying to sit back just to adjourn the matters, but Justice Kathawalla was very patient while hearing each matter. The efforts made by the judge are commendable,” said Khandeparkar.
