The Brihanmumbai Municipal Corporation (BMC), in a pioneering move, has decided to grant special maternity leave to an employee who became a mother via surrogacy.

In line with the state government's circular from the General Administration Department dated November 9, 2016, it is binding on the civic body to grant special leave of 180 days for woman employees to take care of their children born from surrogacy. The decision was implemented from January 2016.

Though the employee was eligible for leave, her application was rejected because she didn't apply in advance, which is mandatory for special leave. She applied again on 7th March 2018 and the civic administration requested BMC's General Assembly to sanction the leave on humanitarian grounds.

"The BMC is implementing the decision as per state government circular," said a senior civic official. "We can't reveal any data about the woman as it is a matter of privacy."

Meanwhile, experts welcomed the move and feel other government bodies and companies should emulate it. "At present, there is only a draft bill on surrogacy," said counsel Jai Vaidya, "which has been reviewed by a parliamentary standing committee but is yet to be passed into law. However, the status of a woman should not be questioned; she should be granted her leave to take care of her child."

"Gone are the days when companies would harass employees over long leaves," says Sanjay Ghanghaw, former HR head of the Somaiya group, "Now maternity leave is a law and no one messes up with it. The workplace is changing in favour of women."
