BMC issues notices to 11 schools for failing to admit students under RTE

The Brihanmumbai Municipal Corporation (BMC) has informed the Bombay high court that it has issued notices to 11 schools in the city for failing to admit students under the Right To Education (RTE) Act.

Anil Sakhare, counsel for the BMC, informed a division bench of justices AV Mohta and Amjad Sayed which is hearing a public interest litigation (PIL) filed by Anudanit Shiksha Bachao Samiti, an NGO, on behalf of affected parents of children have not got admission under RTE Act.

The civic body has said that they will wait for a reply from these schools after which they will forward necessary recmmendation to the director of education.

The HC, during the hearing on August 1, had sought clarification from the government over the confusion prevailing in implementing the RTE as to who would bear the extra cost in case the school fees exceed the stipulated fee amount.

The judges had also remarked that the government had not spread enough awareness on the matter or informed parents that children would be provided books as well.

Advocate general Darius Khambata said on Monday that they would be spreading more awareness and will take necessary steps. Khambata said that they will file an affidavit in three weeks, giving details of steps taken by the government in the regard.

The government has also been asked to clarify its statement that it was planning to extend RTE provisions to junior and senior KG as well. RTE is currently applicable only from Class 1.

The government had sanctioned Rs 12,315 as fees for the academic year 2012-13 and Rs 14,621 for 2013-14. The fees in private unaided schools are sometimes higher than this and hence parents fear they may have to shell out the additional amount. They also fear having to buy books which are too expensive.

The government also reiterated it would leave the seats vacant in case there were not enough students to be admitted under RTE.

The HC has kept the PIL for further hearing after three weeks.
