Bhujbhal case: Bombay High Court allows cross verification of medical report

The Bombay High Court on Friday allowed the counsel of the former minister Chhagan Bhujbhal to cross examine the medical report submitted by the nine-member medical board after thoroughly examining Bhujbhal.

Justice Dr Shalini Phansalkar Joshi has allowed the temporary bail plea to be posted for further hearing on June 8. It said, "Since both parties (defense and prosecution) have consented for adjournment the same is granted."

Counsel Amit Desai, appearing for Bhujbhal, argued that the report is very technical and he would need to consult a medical expert to verify and cross check the reports, in order to give proper assistance to his client and court.

However, government pleader Poornima Kantharia argued that no two doctors will ever give a same opinion and it is unheard of that a private doctors is allowed to opine on the report submitted by nine-member committee.

Bhubjal has moved the court seeking temporary bail on the grounds that his health is deteriorating and he needs to be admitted to a private hospital for further medical aid. Kantharia, though, opposed the plea saying that all the medical help is being provided at the prison hospital or the JJ hospital.
