Ban instant triple talaq: Muslim lawyers

Some Muslim lawyers in city on Saturday held a press conference stating that instant triple talaq should be banned. These included ones representing the Haji Ali Dargah Trust that was opposing the entry of Muslim women in the inner shrine of the Dargah. They, however, added that banning triple talaq given over three menstrual cycles will be against the spirit of Quran.

"What is called as Talaq Bidiya or triple talaq in (one) stroke by uttering the words three times is discriminatory. In fact the Prophet too criticized it. Nowhere does the Quran say that instant talaq is allowed. In fact, it talks about triple talaq only over a period of three periods (menstrual cycles). Even in that case, if a person has sexual intercourse, the (utterance of) talaq till that time is void," said advocate Shoaib Memon, who represents the Haji Ali Dargah Trust.

He demanded that besides banning, it should also be penalised. "Unless there is punishment, it will not be stopped. It is an irregular practice and suppression of right of women," added Memon. Shoaib held the press meet along with advocates Asif Memon, who works with him and advocates Ginny Ahuja, Iram Memon, and Naziya Shaikh.

"Even Sati and untouchability were banned and made criminal offence. It is gross injustice and even Prophet has criticises it," said Memon. Feroze Mithiborewala said, "They say it (ban) should be from community. Are they deaf that community women are seeking ban on it? All India Muslim Personal Law Board (AIMPLB) members indulge in fear mongering because otherwise they will have to shut shop."

Speakers said that various customs were integral part of Union and they cannot be changed. They also informed that women's group in Govandi and Benaras too were having signature campaign against AIMPLB's signature campaign. They declined to comment on the petition and demand made by Muslim women on issues besides triple talaq like polygamy, nikah halala among others. "Today's meet was only about triple talaq," said Mithiborewala.

"Banning triple talaq that runs over a period of three menstrual cycles will be against the spirit of Quran," said Memon demanding that Muslim personal law be codified. "Why are they not codifying the Muslim personal law like other personal laws of various religions?," he asked.

When asked about the fear among the AIMPLB that government in the garb of banning triple talaq would surreptitiously implement Uniform Civil Code (UCC), the speakers said, "The Sangh has never put a draft of UCC. India is a very diverse country. What will they be doing?," said Mithiborewala. On practice of divorce being included in the mainstream.

The speakers also said that first draft of what UCC will be should be decided. "A civil code in the form of Special Marriage Act, already exists" said Shoaib. "The Shariah Act of 1937 is also man-made. It is not divine for those opposing to say that other laws cannot be made," said Mithiborewala.
