Balance Metro work, rights of residents: Bombay High Court

The HC observed the project would benefit lakhs of Mumbaikars and efforts should be made to ensure work progresses smoothly as it declined to relax restriction on work during night hours.

The Bombay High Court came out in support of the Mumbai Metro on Friday and suggested a “workable solution” should be arrived at between its operator and residents who complain of noise pollution caused by the work.

The division bench comprising Justices A S Oka and Riyaz Chagla, however, declined to permit MMRCL to carry out construction work for Metro III line at night till August 10 by when the Pollution Control Board would submit its report on ambient noise levels at Cuffe Parade. 

The HC observed the project would benefit lakhs of Mumbaikars and efforts should be made to ensure work progresses smoothly as it declined to relax restriction on work during night hours. “Some balancing act is required,” the court said.
