Rahul Raj Singh's anticipatory bail plea was rejected by the sessions court at Dindoshi on Thursday. The police would arrest Singh, once he is discharged from a Kandivli-based hospital where he is currently admitted.

Actress Pratyusha Banerjee's mother Shoma Banerjee, on Tuesday, had registered a police complaint against Singh alleging that he would torture Pratyusha and hence she committed suicide.

Pratyusha's parents were present in the courtroom, presided by judge Khwaja Farooq Ahmed, during the hearing.

"Singh had not fought with Pratyusha and the marks around her neck are due to hanging. The deceased have not left any suicide note so it would not be right to arrest my client as she has not blamed anyone for her death," said defence counsel for Singh.

He argued, "There is no abetment nor instigation for this serious crime done by Pratyusha and it is also important to notice the conduct of my client during the mishap. As he opened the door, got the body down from the ceiling fan and immediately rushed her to the hospital." He added, "Pratyusha was under financial pressure as she had taken loans from few banks and also was not getting work since last ten months. Singh used to pay for her expenses as she was suffering from depression and was unable to manage her finances."

Countering the allegations, Shoma Banerjee's lawyer Falguni Brahmbhatt said, "Pratyusha used to share her problems with her mother and her close friends. The applicant (Singh) was using my client's money and was also using her credit and debit cards. He was torturing and assaulting my client physically with his another girlfriend Saloni Sharma. Sharma has not yet been called, by the police, for questioning and recording her statement.

Moreover, the bank records of my client states that Singh had withdrawn Rs24 lakh from her account. Also the conduct of Singh sounds fishy as he had the keys with him yet he relied on the key maker to open the door. The question is that why Singh did not call or inform the police by calling at 100? Nobody knows whether my client had written a suicide note or not and since Singh was the first person to enter the spot then possibly he must have destroyed all the evidences."

Brahmbhatt added, "Pratyusha was not depressed in life. She was a strong girl and cannot take this step. Singh took Pratyusha to the hospital and as soon as the police arrived he disappeared from there along with Pratyusha's cell phone. At this time the investigation is at preliminary stage and this case should also been taken as a pre-planned murder."

After hearing arguments from both the sides, the judge rejected the bail plea of Singh.

Brahmbhatt said, "After proper investigation we shall come to a conclusion that whether this is an abetment case or a murder. Pratyusha's parents have recorded their statements before the police and I believe that Singh must have destroyed all the evidences. Many witnesses have seen Saloni assaulting Pratyusha along with Rahul at the couple's place."

Police inspector Deepak Phatangare of Bangur Nagar police station said, "Investigation is on and the police is trying to gather evidences from the spot. Singh is still hospitalised and as soon as he recovers we will take action against him."

Since, Singh has not received relief from the sessions court, he is likely to move High Court to seek anticipatory bail.
