A Thane family court granted a 32-year-old man with a divorce from his wife, who physically assaulted him. The man suffered for 13 years, but being hit on his groin was the final straw; he sought divorce on the grounds of cruelty.

The couple got married in November 2000, and the claimant said that 'right from day one', his wife was extremely cold towards him and had a reserved nature. His petition read: "The couple was initially staying with the man's parents after their marriage. The wife disliked this and the couple therefore ended up fighting. As the man was working with power looms in two shifts of 12 hours each and would reach home late, the woman used to end up fighting with him on flimsy grounds."

The couple and their three children moved away from the house of the man's parents to a place in Thane, but the wife's behaviour remained unchanged. In his petition, the man also said: "One day, the wife came home very late when the man was waiting for her at home. He thus questioned his wife why she returned so late, but the wife pounced on him, tore his clothes, slapped and kicked him on his private parts. She left their house without the children."

After going through the evidence, the judges asked the woman to file a reply, but she didn't bother responding. The court held that since there was no challenge to the allegations leveled by the man, this proves that the wife is guilty of 'causing mental and physical cruelty', and thus granted the husband divorce.
