Advocate tenant may move Bombay High Court over permits for repair

Advocate Ashok Sarogi, who is one of the tenants of the Esplanade Mansion, where a slab collapsed on Sunday, is likely to approach the Bombay High Court, seeking directions to the Brihanmumbai Municipal Corporation, to grant them No Objection Certificate, for carrying out repairs, to the over-a-century-old heritage building.

Sarogi had in 2015, moved the High Court, when authorities, issued an eviction notice to the tenants and owners, after the building was declared dilapidated and dangerous to occupy.

Accordingly, the court had granted stay on the eviction notice. But noted that tenants were occupying the premises at their own risk.

Sarogi said "MHADA has already granted NOC for carrying out repairs, it is only the corporation which is sitting on our application, if permission is given, the tenants and owners of the building are in agreement to appoint an architect and structural auditor, to assess the dangerous portions of the building and repair it at our own cost."

As per the list of dangerous buildings in the city issued by MHADA, Esplanade Mansion, ranks on the top. Chief Officer of MHADA repair and reconstruction board, D K Jagdale said "In total, there are seven most dangerous buildings in the city; Esplanade Mansion, tops the list. There is a status quo issued on the demolition of the building, as tenants had moved court earlier. MHADA will submit its report about the recent slab collapse incident, and follow subsequent High Court orders."

Advocate Rajesh Singh, who has an office in the building said "Though my office is not affected due to the slab collapse. But this is a reminder to us to follow up with the owner of the building to carry out necessary repairs. We hope, this issue is taken up at the earliest and resolved."

However, Sargoi who may approach HC, is known for representing gangster Abu Salem, after he was extradited to India from Portugal.
