Openwave said its patents for technologies used to connect mobile devices to the Internet were infringed by Apple and RIM's smart phones and tablet devices.

Software maker Openwave Systems Inc filed a complaint against Apple Inc and Research In Motion Ltd, alleging infringement of five of its patents.

Openwave said its patents for technologies used to connect mobile devices to the Internet were infringed by Apple and RIM's smart phones and tablet devices.

"Before filing these complaints, we approached both of these companies numerous times in an attempt to negotiate a license of our technology with them and did not receive a substantive response," Openwave Chief Executive Ken Denman said.

Openwave, which owns about 200 patents, filed the complaint at the International Trade Commission in Washington DC and also at a federal district court in Delaware.

Shares of the Redwood City, California-based company were up 30 cents at $1.77 in morning trade on Nasdaq.
