Metropolis Healthcare asked to pay over Rs 1 lakh as penalty for changing location

Even a change of location, by the service providers can land them in soup, thus costing a huge penalty. The Central Mumbai District consumer Dispute Redressal Forum, recently pulled up the Metropolis Healthcare Ltd, for changing its location, thus asking the well known firm to pay back the total amount of Rs 77,000 which one of its consumer had rendered to the firm for its services. The forum has asked the firm to pay back the amount along with 9% interest rate from the year 2015, with an additional amount of Rs 10,000 towards the complainant's mental agony, and Rs 10,000 towards the litigation charges occurred to him.

Aziz Jadwet, a resident of Mumbai,in the year 2011, had registered his children's name with the firm in order to get orthodontic treatment for his son and daughter, for which he had paid a total amount of Rs 77,000. The treatment was going on at Madam Kama road opposite Mantralaya, in the Mantralaya centre. However, in June 2015, Jadwet came to know that, the dental treatment was outsourced to Sidvim life sciences, and he was informed that the dental department at the Mantralaya centre is going to be closed. the complainant was asked to visit the new location Goregaon, if he wishes to pursue the treatment ahead. Jadwet in his complaint said that this move was going to cause him hardship and inconvenience. Thus he approached the forum and filed a complaint against the firm.

The firm in its reply claimed that there was an agreement between the firm and Sidvim Dental Care Pvt Ltd, which was providing orthodontic treatment by specialised doctors. The work of the firm was limited to clerical. The firm was not providing orthodontic treatment, but was just collecting payment for services rendered by Sidvim on her behalf. There is no deficiency in service on the part of the firm and thus the complainant is not entitled for the relief.

The forum after going through the evidence brought on record, maintained that at the time when the complainant had filled the form for treatment, he had specifically mentioned the location apt for him, and the same was also accepted by the firm. However before completion of the treatment, the firm abruptly moved to a location which was at quite a distance for the complainant. The complainant's kids are school going and thus it was not possible for them to attend the clinic in Goregaon. it will definitely cause them inconvenience, thus changing of location, does amount to deficiency of services.
