Will challenge Gurjar quota: Samta Aandolan Samiti

SAS has termed the said reservation to be in violation of the Rajasthan High Court order dated 9 December 2016 and the Supreme Court order dated 3 February 2017.

Even as the Gurjars are in the process of negotiating the implementation of one percent quota allocated to them under the Most Backward Community (MBC) category, the Samta Aandolan Samiti (SAS) is gearing up to challenge this reservation. SAS has termed the said reservation to be in violation of the Rajasthan High Court order dated 9 December 2016 and the Supreme Court order dated 3 February 2017.

The HC had said in the order that the Backward Communities Commission had not undertaken proper study or provided facts that supported inclusion of Gurjars in SBC category, as implementation of order dated 22 December 2010. It also observed that one community had claim to 30% quota of total reservation and therefore as per Indira Sahani judgement communities with adequate representation should be moved out of list of those reserved under OBC. If this is done reservation limit will not have to be increased to accommodate others.

“In its judgement dated 3 Feb 2017, given on the SLP of Rajasthan government, (against the 9 Dec 2016 judgement) the Supreme Court had ordered a status quo on the reservation limit, which was 49% on that day. The 1% MBC reservation puts total reservation at 50%; this is beyond the 49% limit as on 3 Feb 2017, so it is a violation of the SC order. We are in the process of challenging it in court,” said Parashar Narayan Sharma, president Samta Andolan Samiti to DNA.
