Supreme Court reverts master plan case to Rajasthan High Court

The state government has also proposed for a new ‘urban planning’ bill to provision for modifications in master development plans.

A three judge bench of Rajasthan High Court will decide on the issue of modification in existing master development plan. The Supreme Court while hearing on a special leave petition of Rajasthan government has reverted the case to be decided by a three judge bench of High Court. The Rajasthan high court previously while deciding on Gulab Kothari case had ordered against alterations in the master development plans and the state government had gone to Supreme Court against the decision. 

However, the high court decision has not been stayed by the apex court and hence the state government will still face difficulties in making the desired changes to the master plan. The state government meanwhile is in hurry to get the changes made before upcoming elections in order to regularise ‘illegal’ colonies to have come up in contradiction to master plan provision. 

The state government has also proposed for a new ‘urban planning’ bill to provision for modifications in master development plans. 

Bill Not Tabled

The bill, however, despite taking public objections on the draft, was not tabled during the budget session. Now even as the apex court has asked the HC to decide on the matter soon the issue is expected to be extended.
