Rajasthan Info Panel asks courts to reduce RTI application fee

The fee is Rs 100 in courts & Rs 10 in state govt offices

Citing an order of the Supreme Court, the Rajasthan Information Commission has asked all the courts in the state, including the High Court to reduce RTI application fee.

In the state, the RTI application fee at present is Rs 100 in the courts, whereas in the state government offices, the fee is Rs 10. Referring to a decision of the Supreme Court, State Information Commissioner Ashutosh Sharma said in his decision that the High Court administration expects the deduction of application fees. The copy of the decision of the Commission has been sent to the Registrar, Rajasthan High Court, Jodhpur.

The Information Commissioner Sharma gave this decision while disposing of the second appeal of Andara Chaudhary a resident of Merta City. Chaudhary had filed an RTI application to the Chief Judicial Magistrate, Merta City with a fee of Rs 10. This application was rejected because it was not carrying Rs 100 judicial stamps. Under the Right To Information Rajasthan High Court and Subordinate Courts Rules 2006, the fees prescribed is Rs 100.

On this, Chaudhary filed a second appeal in the Information Commission.

Information Commissioner Ashutosh Sharma said in his decision that the Supreme Court has ruled in a matter relating to the Allahabad High Court, that the RTI application fee should not be more than Rs 50 and the copy fee should not exceed Rs 5. On this basis, the Rajasthan High Court administration should reduce the current application fee by Rs 100. Sharma also gave instructions to send the copy of the order to the High Court. 

To reduce the RTI application fees in the state courts, the High Court will have to amend the Rajasthan Right to Information Act High Court and Subordinate Courts Rule 2006. In these rules, RTI application fee has been fixed at Rs 100 only.
