Rajasthan High Court stays punitive action against Vidyashram School

Court has also sought reply from principal education secy & others

Rajasthan High Court on Tuesday, taking cognisance on a writ petition filed by Bharatiya Vidya Bhavan Vidyashram School, restrained the education authorities from taking any punitive action against the school. A division bench of Judge Manish Bhandari and Judge DC Somani passed this order.

The High Court also sought a reply from Principal Secretary, School Education, Director of Primary Education, and District Education Officer, secondary education on the issue of  Rajasthan Schools (Fee Regulation) Act, 2016.

The affidavit presented by the petitioner stated that the school has increased the fee by 20 per cent as the school was implementing the recommendations of the Seventh Pay Commission.

“In addition to this, the state government only provides Rs 17,000 per student under Right to Education, while the actual expenditure is more than that. Further, Rs 200 per month is being charged from the student Digital Board.

The Board Trustees are providing services without charging any fee,” the affidavit stated.The petitioner further stated that the institution does not levy any grant from the state, and hence, the fees act is not applicable to it. “A fee committee has been formed and the person nominated by the state government is the school’s representative in the committee.

The District Education Officer banned the school from increasing the fee on April 20, while the official is not authorised to do the same. The Supreme Court has already decided that the schools can increase the fee based on the services and resources provided,” the affidavit said.
