Rajasthan High Court stays arrest of Twitter CEO Jack Dorsey

Dorsey had, in his petition, said that the FIR is nothing but an abuse of the criminal justice system.

The Rajasthan High Court has put stay on the arrest of Twitter CEO Jack Dorsey, but has refused to cancel the FIR lodged against him.

An FIR was filed at the Basni police station by Rajkumar Sharma against Dorsey for hurting the sentiments of Brahmin community after his photo holding the slogan after his photo holding the slogan “Smash Brahminical Patriarchy” went viral. Before the high court, Dorsey was represented by senior advocate Mahesh Jethmalani along with advocate Sandeep Kapur, Senior Partner, Karanjawala & Co, Principal Associate Vir Inder Pal Singh Sandhu; Associates Abhimanshu Dhyani and Tushar Thakur and advocate Ravi Sharma.

Dorsey had, in his petition, said that the FIR is nothing but an abuse of the criminal justice system. He said he did not flaunt the placard but had merely held it “innocently without the deliberate and malicious intention”.

“Since the petitioner was not responsible for the publication of the offending photograph, there was no question of him intentionally or knowingly insulting any person, to break public peace or to commit any other offence,” Dorsey said in his petition.

The counsel for Rajkumar Sharma, Hastimal Saraswat, pleaded before that the court Dorsey has humiliated Brahmin society.

“The court asked them to submit any document or evidence in support of their arguments in the court,” Saraswat said. A court had issued directions to file an FIR against the Twitter CEO on December 1, following which a case was registered against him at the Basni police station.

Petitioner Rajkumar Sharma, a member of Vipra Foundation, had moved the court after he shared a picture on his account showing him with six women holding a poster in his hands that said “Smash Brahminical Patriarchy”. 

After hearing both the sides, Jusitice PS Bhati granted a stay on Dorsey’s arrest It was further observed that there was no prima facie case for interrogation.
