Rajasthan High Court rejects petition against JDCA polls

The court said that the petitioner has an option to appeal to principal secretary sports against the order of registrar cooperatives.

Paving way for Jaipur District Cricket Association’s (JDCA) election scheduled to be held on March 18, the Rajasthan High Court has rejected a petition against it.

The court said that the petitioner has an option to appeal to principal secretary sports against the order of registrar cooperatives. Justice Indrajit Singh said that once election process begins, the court cannot interfere. The petition was filed by JDCA, which challenged January 18 order of registrar cooperatives to annul JDCA’s election held in 2016. The registrar had also dissolved the present executive and asked form an ad hoc committee to hold elections.

The JDCA claimed that 2016 elections were valid and the registrar’s order was illegal. The state government opposed it saying that as per sports act’s section 35, appeal against registrar’s order can only be filed before principal secretary sports and revision of sports secretary’s order is filed in the high court. But the petitioner has filed the appeal directly in the high court. Besides, election programme has been announced; hence the court has no right to interfere. Registrar had ordered probe following complaints of voting by fake clubs and dissolved present executive while constituting an ad hoc committee following report filed by the investigating officer.

Govt Opposed

  • State govt opposed it saying that as per sports act’s section 35, appeal against registrar’s order can only be filed before Principal Secy sports and revision of sports secretary’s order is filed in the HC.
  • Besides, poll prog has been announced; hence the court has no right to interfere.
