Rajasthan High Court extends deadline for PUC certificate

The court said that there should be a pollution center on every petrol pump. The division bench of Justice Manish Bhandari and Justice DC Somani gave this order during the initial hearing.

Rajasthan High Court stayed the imposition of penalty imposed on the delay in renewing the PUC certificate of two-wheeler and four-wheeler vehicles. Hearing a petition filed by one Banwari Lal Sharma, bench of justice M N Bhandari also stayed the Rajasthan Motor Vehicle Pollution Testing Center Scheme (Online)-2017.

Along with this, the court has issued notice to chief secretary, transport commissioner and RTO, Jaipur and has sought a reply from them. The court said that there should be a pollution center on every petrol pump. The division bench of Justice Manish Bhandari and Justice DC Somani gave this order during the initial hearing.

In the petition, advocates Prateek Kasliwal and Divesh Sharma informed the court that the state government has no right to acquire such a penalty for not getting the PUC renewed after expiry. Under Section 190 of the Motor Vehicles Act, there is a provision for imposing penalty if there is no PUC. In this case, the implementation of Rajasthan Motor Vehicle Pollution Testing Center Scheme (Online)-2017 should be banned.

The charges of this online testing facility for petrol run two-wheeler had been kept at Rs 50 while 3-wheeler and 4-wheelers running on petrol, LPG and CNG will have to pay Rs 70. The rate for diesel vehicles has been kept Rs 100. Seeing the large number of vehicles, the date was extended and it was decided that 3 datelines will be given for various vehicles having registration numbers between 0-2000 , 2001-5000 and 5001-10000.
