Rajasthan government takes steps towards formalising RERA

Authority has been on ‘ad hoc’ basis for over a yr

The state government has decided to formalise the Real Estate Regulatory Authority (RERA) in Rajasthan following high court taking cognizance of the issue. The authority constituted under the Real Estate Regulatory Act of 2016 has been operating on ‘ad hoc’ basis for more than a year.

The urban development and housing department has written to the law department regarding constitution of selection committee for appointment of the authority. The department has sought the committee to be presided by chief justice of the Rajasthan high court or his representatives and will have secretaries of the local self-governance and urban development as members. 

A bench of the Rajasthan high court has recently stayed implementation of all orders of the authority following a case moved by local wing of real estate developer body and others. The court had also sought the urban development department to submit explanation on non-constitution of the authority in accordance with provisions of the act.

According to the act, a dedicated appellate tribunal is to be constituted to decide issues related to RERA. However, a year has passed since implementation of the act, the Food Safety appellate remains designated as RERA tribunal. Under the RERA provisions the RERA appellate is required to be presided by a sitting or retired high court judge. As the hearing on the case is scheduled next week, the urban development ministry has moved ahead with process to comply with the act provisions. 

RERA Focus On Rural Areas

The urban development department has written to district collectors for sharing details of real estate projects in their area with the state real estate regulatory authority. RERA registration remains mandatory for all upcoming real estate projects in the state. However, the registration of projects in the rural areas has remain comparatively low. Thus, the authorities now seek for information regarding such projects.
