Rajasthan gets unified building bylaws

This may ensure transparency with few exceptions

Unified building by-laws 2017 in the state will replace all existing building legalities implemented by local development bodies at various urban areas across Rajasthan. The urban development department on Wednesday, formally approved the 'Unified bylaws'. A notification in this regard is awaited. This is expected to largely ensure transparency, with a few exceptions.
 
The issue of 'unorganised colonies' and slum development will be decided by local bodies. They can allow development in these areas in accordance to local bylaws. These exceptions will also be applicable on townships and areas of heritage and tourism relevance.
 
"The unified bylaws will ensure transparency," says additional chief secretary urban development, Mukesh Sharma. "The exceptions spared from the limits of these bylaws will still have to comply with other laws applied by local bodies," he added.
 
It's the first time that a state-wide building law has come under implementation. This redefines the building scenario across the state. Introduction of Builtup area ratio (BAR), replacing the floor area ratio (FAR) will simplify the process for calculating floor area, the parking norm of ECU per 75 square metre of built-up space for commercial areas has bothered the developers. While the relaxation from plan approval to plots less than 162 square metre area also seems to promote asymmetric constructions in residential areas.

"The relaxation granted to developments on plots of less than 162 square metre will promote unorganised development and challenges for provision of basic amenities,"  president of CREDAI, Rajasthan Anurag Sharma expresses reservation on the issue, even as he welcomes the new bye laws as a step towards transparency and accountability.
 
The new building bylaws divide urban areas under five categories: the panchayat area under limits of an urban body, Walled City areas, unplanned densely populated localities and development schemes approved before implementation of the unified building bylaws 2017.  All the remaining urban areas will now be under jurisdiction of the unified by laws, that cover all sorts of constructions including hostels, coaching centers, residential projects, cinema halls, commercial projects and others.

In case Stilt floor has been reserved exclusively for parking, the floor above stilt floor will be considered as Ground floor.
