Rajasthan: Building bylaws await amendment

Amendment of building bylaws remains in anticipation as urban development department reviews its functioning under a new government in the state. The former BJP government had introduced Unified building bylaws in 2017 to replace local bylaws implemented in different cities. The new Congress government though seeks to have them mended according to contemporary local needs. “Government is in favour of regional decentralisation and increasing public participation in urban development and thus the building bylaws and other urban development rules are in review,” says an official. 

The Congress, in its assembly election manifesto, has assured of many changes in the urban development scenario. As Shanti Dhariwal once again assumed the office of the urban development minister, the department is in the process for the change. Officials, meanwhile, suggest the change to be in direction for sustainability. Among several other factors including those of fire safety management and parking, a proposal for promotion of green building remains under consideration of the government. 

According to the officials, present bylaws provision for an additional 7.5 per cent floor area for green buildings. The benefit gets extended only after the building construction is completed. The new amendment proposes to increase the additional floor area to 15 per cent and have the benefit extended to the developer at the time of building plan approval.

“The proposal is made after taking into consideration the provisions of building bylaws of several states, however, the issue remains subject to further consideration of the government,” says a town planning official. Green buildings projects are suggested to be classified into three categories on established parameters and accordingly extended additional floor area construction permits of 7.5,10 and 15 per cent. Implementation of the provision will though require the appointment of a Green building regulatory body at the state.  

In the direction towards sustainable change, amendments in building bylaws are also expected to address upon issues of parking, fire safety and affordable housing. Meanwhile, the local bodies are expected to get more relaxations in accordance with the local development needs.
