Jaipur: Future of law students in limbo

The future of first year and second year law students at University of Rajasthan is in limbo as the Bar Council of India (BCI) had only approved the courses till 2014-15.

According to the show cause notice given by BCI to University of Rajasthan, “In Sr No 15, university is running three-year law course, approval of is up to 2014-15. In Sr no 16, the same university is running five-year BA LLB law course, approval of which is also up to 2014-15, and at Sr 17, it is also running three-year law course approval of which is for 2014-15.”

It is to be noted that the university, despite non-renewal of the affiliation, admitted students in the year 2015-16 and 2016-17. These students may not receive a valid degree after completion of the five-year course.

“We will be unable to register ourselves in the Bar Council due to non-validation of the degree. The Bar Council usually extends their dates for demand of permanent faculties, based on which the university had taken admissions in last two years. Now, the affiliation will only happen if there is permanent faculty in the college,” said Saurabh Poonia, a second year student at University Five Year Law College.

SL Sharma, director of the five-year Law College, informed DNA that an application has been sent for 25 posts to the Government of Rajasthan.

“The last inspection was done in 2014-15 and since then BCI has been silent. They have now suddenly issued instructions to discontinue admissions from this year. BCI doesn’t do regular reviews as they are not willing to conduct inspections every year,” Sharma said.

Ajatshatru Meena, a city-based lawyer, stated that having a degree from a non-BCI affiliated college is equivalent to having a non-CBSE affiliated higher secondary certificate.

“The person will not be considered a lawyer anywhere in India,” he added.

Invalid Degree?

  • It is to be noted that the university, despite non-renewal of the affiliation, admitted students in the year 2015-16 and 2016-17. These students may not receive a valid degree after completion of the five-year course.
  • “Having a degree from non-BCI affiliated college is equivalent to having a non-CBSE affiliated higher secondary certificate.”
