Face music if wrong info: Rajasthan High Court to officials

The Rajasthan high court has sought affidavit regarding compliance of its order for removal of encroachments from Ramgarh dam and other water resources in the state. The court warned officials that if wrong information was provided, then action will be taken against them under Section 340 of CrPC. The high court has asked chief secretary and pollution control board to monitor this. The court has asked Dausa collector to appear on May 3. The division bench of Justice Manish Bhandari and Justice DC Somani gave these orders on a suo motu cognizance petition.

During the hearing, JDA secretary, commissioner JMC, ACS of forest, mines, revenue, industry and other departments were present in the court.

Replying to the query by the court, JMC commissioner said that from Jaisinghpura Khor STP plant 15 MLD untreated water is being discharged into Kanota dam. He said that because of Supreme Court’s stay in Jal Mahal case, the nullah could not be repaired. To this the court said that why he should not be sent to jail for violating pollution control act and contempt of the court. The bench told pollution control board chairman that why action was not taken against officers despite having powers. The court asked forest official that there are 400 anicuts in Ramgarh dam area how much forestation increased because of them. When these anicuts don’t have for more than 17 days water why were they constructed? It is because of them water was not reaching the dam. The court pulled officials department wise. “Orders are passed only on papers but officials are not taking action on the ground,” the bench said.

The court also expressed dismay that newly-constructed road caved in. Commenting on state government’s functioning, it said that where there is sewage there is no STP but there is STP where no sewage line.
